Former U.S. President Donald Trump is once again fueling speculation about a potential return to the
political arena in 2028, despite constitutional limitations. The wall Street journal (WSJ) recently
reported on these murmurings, highlighting the creative, if legally dubious, strategies being
considered by Trump’s inner circle.

The core issue revolves around the 22nd Amendment to the U.S.Constitution, which explicitly states
that “no person shall be elected to the office of the President more than twice.” This amendment,
ratified in 1951, was a direct response to Franklin D. Roosevelt’s unprecedented four terms in
office.however, Trump’s associates are reportedly exploring loopholes and alternative pathways for
him to perhaps circumvent this restriction.

The “Three-Line Challenge” and Legal interpretations

One potential approach, often referred to as the “three-line challenge,” involves exploiting a perceived
ambiguity in the 22nd Amendment. The argument, reportedly floated by some of Trump’s advisors, is that
the amendment only prohibits serving more than twice consecutively.Since Trump would be out of office
for four years after a hypothetical 2024 term, this break in service could, in their interpretation,
reset the clock, allowing him to run again in 2028.

While this interpretation is considered highly unlikely to withstand legal scrutiny, it underscores the
lengths to which some Trump loyalists are willing to go to keep his political future alive. Legal scholars
across the political spectrum have widely dismissed this argument.

“Trump will find a way to play again in 2028,”

boris Epstein, Trump’s lawyer, as reported by the Wall Street Journal

This statement, made in late 2023, suggests that the possibility of a future Trump candidacy has been a
topic of serious discussion within his inner circle. According to the WSJ,epstein’s remark was initially
dismissed as a joke by a fellow lawyer, but recent developments have caused some to reconsider its
seriousness.

The Vance Gambit: A Constitutional Minefield

Another, even more audacious scenario involves a complex series of political maneuvers. As the WSJ
reports, this scenario would theoretically involve Trump running wiht a vice-presidential candidate,
potentially J.D. Vance, who would than resign after winning the election, paving the way for Trump to
assume the presidency.

However, legal experts point to Article 12 of the U.S. Amendment Constitution, this stipulates that anyone
who cannot run for the presidential election cannot be vice president, WSJ said.

Constitutional Provision Description Potential Issue
22nd Amendment Limits presidents to two terms. Trump has already served one term and is seeking another.
Article 12 Amendment Anyone who cannot run for the presidential election cannot be vice president Prevents individuals ineligible for the presidency from becoming vice president.

Reactions and Implications

When asked about the possibility of a 2028 run, Trump himself has remained coy, neither confirming nor
denying his intentions. In a recent television interview, he stated:

“I’m not a joke. There is a way.”

this ambiguous response has only fueled further speculation and debate.

The White House has declined to comment directly on the matter, stating that it is indeed too early to speculate
about future elections. Though, the very fact that these scenarios are being discussed at all reflects the
unconventional nature of contemporary American politics and the enduring influence of Donald Trump within
the Republican Party.

The implications of such a challenge to the 22nd Amendment would be profound, potentially opening the
door to future attempts to circumvent constitutional norms and weakening the safeguards against the
concentration of power. It also raises questions about the role of the Vice President and succession.

Looking Ahead

Whether Trump ultimately chooses to pursue a 2028 candidacy remains to be seen. However, the ongoing
discussion surrounding this possibility highlights the need for a robust defense of constitutional principles
and a commitment to upholding the rule of law. As Americans look towards future elections, the
integrity of the democratic process depends on a clear understanding and unwavering adherence to the
Constitution.
