Samsung Secures Reprieve in Major Tax Dispute
In a significant victory for Samsung India, the Delhi High Court on Monday overturned a ruling by the Income Tax Appellate Tribunal (ITAT) that had dismissed the company’s plea for a stay on a ₹1,213 crore tax demand. This decision brings welcome relief to the Korean tech giant, providing it much-needed breathing room as it navigates a series of challenges in India.
The High Court bench, comprising Justice Vibhu Bakhru and Justice Swarna Kanta Sharma, reinstated Samsung’s stay application and instructed the ITAT to promptly re-evaluate the matter on its merits.
A Dispute Over Timing
The tribunal’s initial rejection of Samsung’s plea on November 22nd stemmed from its classification as “premature.” The ITAT argued that Samsung had not demonstrated any immediate recovery actions taken by tax authorities at the time of filing or during the hearing of the application. The absence of an imminent threat led the ITAT to dismiss the request.

Undeterred, Samsung appealed the decision to the Delhi High Court, which ultimately ruled in its favour and set aside the tribunal’s determination.

“This is a welcome ruling as taxpayers have been facing uncertainty as their bank accounts can be attached through recovery proceedings by the tax department, anytime by giving just a few days notice. So even though, the department hasn’t taken any coercive measure the fact that the demand is outstanding, taxpayers can, as a pre-emptive measure, get a stay and would not have to worry about running to the courts when the department takes action,” Maheshwari said.
This latest development adds another chapter to Samsung India’s ongoing saga with Indian authorities. In 2023, the Directorate of Revenue Intelligence (DRI) issued the company a show-cause notice, alleging customs duty evasion amounting to ₹1,728 crore (approximately $212 million). The DRI contends that Samsung misclassified remote radio heads, a type of networking equipment used in telecom infrastructure, to secure undue exemptions from basic customs duties.
Challenges Mount for Tech Titan
Beyond these tax issues, Samsung is also grappling with operational disruptions at its Chennai factory. Workers at the plant have been on strike for three consecutive days, impacting the production of televisions, refrigerators, and washing machines. This strike adds further complexity to the challenges already facing the company in India.
Further compounding Samsung’s difficulties is its declining position in India’s booming smartphone market. Once the market leader, Samsung has slipped to third place in terms of volume, trailing behind its Chinese rivals, Vivo and Xiaomi. Research firms Counterpoint and Canalys estimated Samsung’s market share for the April-June quarter at 18% and 17%, respectively. Vivo and Xiaomi each hold around 19% of the market.
