Contractors on New York Public and Certain Private Projects Must Now Register With State

New York Mandates Registration for Contractors and Subcontractors on Public and Private Projects

Starting December 30, 2024, contractors and subcontractors bidding on or performing construction work in New York state will be required to register with the state’s Department of Labor (NYSDOL).

Addressing Public Funding Accountability

“This law provides crucial public funding accountability that significantly benefits law-abiding contractors and subcontractors while effectively cutting off those seeking to exploit workers,” said Labor Commissioner Roberta Reardon.

The new registration requirement in New York applies to contracts and subcontractors on public work projects, as well as certain private projects falling under Article 8 of the Labor Law. This includes projects funded by public subsidies, renewable energy systems, broadband projects, climate risk-related and energy transition projects, and roadway excavations.

Registration Process and Timeline

To avoid potential delays in bidding and project schedules, NYSDOL strongly encourages all contractors and subcontractors to register as early as possible.

Registration applications must be submitted electronically through NYSDOL’s dedicated Contractor Registry portal. Please note, processing times for applications can take three to four weeks.

To register, contractors and subcontractors will need to provide company information, unemployment insurance registration details, and a record of any past workplace safety or tax violations. In addition, proof of workers’ compensation insurance must be included. The application must be accompanied by a processing fee payable by credit card.

Maintaining Registration

Approved applicants receive an electronic Certificate of Registration, which is necessary to participate in bidding or continue with active projects. This certificate can be downloaded and printed by the applicant.

Each Registration Certificate is valid for two years from the date of issuance. To avoid interruption in project work and bidding eligibility, contractors and subcontractors must renew their registration at least 90 days before it expires. Renewal processes, status updates, and application tracking can all be conducted through NYSDOL’s Contractor Registry platform.
